General Terms and Conditions of the shop "outdoorspielerei"

§ 1 – Provider, inclusion of the GTC

(1) The provider and contractual partner for the goods presented in the shop "outdoorspielei" is: Andreas Weber, Averdunksweg 5, 47506 Neukirchen- Vluyn (hereinafter referred to as "provider").

(2) These General Terms and Conditions are an integral part of any contractual agreement between the Provider and the respective Customer. Conflicting terms and conditions of the customer are contradicted.

§ 2 – Offer of goods and conclusion of contract

(1) The provider offers the articles presented in his shop "outdoorspielei" to other users for sale. The items offered are partly new goods, partly second-hand goods (second hand, vintage); please note the respective product description. The colour representation of the articles on the website may vary slightly depending on the Internet browser used and the monitor settings of the customer; these deviations are never technically completely avoidable.

(2) The selection of goods, the conclusion of the contract and the execution of the contract shall be carried out in German.

(3) The provider delivers within Germany as well as to France, Great Britain, Austria, Switzerland and Spain.

(4) The customer selects the desired goods by placing them in the "shopping cart" or by clicking on the button "Go directly to checkout". The order request can finally be transmitted to the provider via the button "order with obligation to pay". The customer has the possibility at any time until the dispatch of his order request to view and change the data provided in the context of the order or to cancel the order completely.

(5) For the goods presented in the shop of the provider, the provider makes a binding purchase offer. By sending the order request via the button "order with obligation to pay", the customer accepts the purchase offer. The provider confirms the conclusion of the contract by e-mail (contract confirmation).

(6) The content of concluded contracts is stored in the customer's user account and can be viewed by the customer in the portal at any time via the menu under the item "My purchases".

(7) In the event of impediments to delivery or other circumstances that would preclude the fulfilment of the contract, the provider shall inform the customer by e-mail. A partial delivery shall only take place with the consent of the customer.






§ 6 – Warranty

(1) For the second-hand goods offered, the parties agree on a limitation period for warranty claims shortened to one year. However, the shortened limitation period does not apply to claims due to injury to life, limb or health and also not to claims for other damages based on a grossly negligent or intentional breach of duty by the provider, his legal representatives or his vicarious agents.

(2) In all other respects, the warranty claims are governed by the statutory provisions.

§ 7 – Final provisions

(1) The provider collects and processes the data entered by the customer as part of his purchase for the purpose of processing and fulfilling the contract. Insofar as the customer uses the service of PayPal for the payment of his purchase, the PayPal data protection regulations apply to the payment process. PayPal acts as a vicarious agent of the customer, not of the provider.

(2) The law of the Federal Republic of Germany shall apply to the exclusion of the UN Convention on Contracts for the International Sale of Goods. However, German law does not apply to consumers with permanent residence abroad insofar as the national law of the consumer contains provisions from which no deviation can be made by contract to the detriment of the consumer.

(3) Should individual provisions of these General Terms and Conditions prove to be invalid or unenforceable, this shall not affect the validity of the remaining provisions.

Payment

3 – Prices and payment

(1) All product prices are final prices plus shipping costs. VAT is not charged.

(2) The shipping costs are listed in the respective product description in the section "Payment & Shipping".

(3) In the case of deliveries to Switzerland, customs duties and import sales tax may be incurred, which are to be paid by the customer to the customs authority upon receipt of the shipment. These charges are in addition to the purchase price and the shipping costs and are not to be influenced by the provider.

(4) The provider delivers at the choice of the customer against advance payment by redeeming a voucher, against advance payment by bank transfer, against advance payment by means of PayPal payment or against cash payment on collection. With the confirmation of the contract (§ 2 para. 5), the customer receives an Internet link by e-mail, which leads him to the "My purchases" area, which contains further information on the purchase process.

a) For payment by voucher, the customer can enter one or more voucher codes in the "My purchases" area. The voucher value is credited to the provider and the invoice amount is paid in this way. If a voucher value is higher than the invoice amount, the voucher remains valid in the amount of the excess amount.

b) If the customer has chosen "bank transfer" as the payment method, the customer will be informed of the bank details of the provider in the "My purchases" area. The provider only accepts transfers from abroad as free payments in euros.

c) If the customer has chosen "PayPal" as the payment method, he can access the online service of PayPal via the button "Click here to pay with PayPal" and can initiate the payment there.

d) If the customer has chosen "cash payment" as the payment method, he can pick up the goods at the registered office of the provider.

(5) For prepayment orders, a payment period of one week from receipt of the contract confirmation applies. The provider shall return the desired goods for the duration of the payment period for the customer. It is the customer's responsibility to effect his payment in time for it to be received by the provider within the deadline. The provider reserves the right to withdraw from the purchase contract and sell the goods elsewhere if payment has not been received by the deadline. Any payment received by the customer after withdrawal will be refunded to the customer.

Shipping

§ 4 – Shipping, delivery periods

(1) The provider shall hand over the goods to be delivered to the shipping company within five working days from receipt of full payment.

(2) Unless otherwise stated in the item description, the shipping company needs about 2 working days within Germany and – depending on the distance – up to 9 working days to other countries for delivery from handover by the provider.

(3) If the delivery to the customer fails because the customer has entered the delivery address incorrectly or incompletely, a new delivery attempt will only be made if the customer assumes the costs for the new shipping. The renewed shipping costs correspond to the shipping costs agreed at the time of conclusion of the contract. The provider will inform the customer of the necessary costs of a new delivery by e-mail. A new shipment will only take place after receipt of payment of these costs.

(4) If the customer has chosen cash payment as the payment method, the goods will not be shipped. Instead, the customer can pick up the goods at the provider's place of business after five working days after the day of the order.

§ 5 – Return of goods as a consumer

(1) Customers who purchase as consumers (§ 13 BGB) are entitled to a right of revocation in accordance with the statutory requirements (§§ 312d, 355 BGB). Details can be found in the cancellation policy.

(2) If the customer is a consumer, the parties to the purchase agreement agree in the event of exercising the right of revocation that the customer bears the regular costs of the return, if the delivered goods correspond to those ordered and if the price of the item to be returned does not exceed an amount of 40 euros or if the customer has not yet provided the consideration or a contractually agreed partial payment at a higher price of the item at the time of revocation.

(3) Insofar as the customer has to bear the return costs, the amount of money to be reimbursed by the provider and the return costs to be reimbursed by the customer may be offset against each other.

(4) Consumers with permanent residence outside Germany are granted a 14-day revocation period by the provider even if the national law of the consumer provides for a shorter period for this.

(5) Consumers with permanent residence outside Germany are permitted by the provider to transmit their declaration of revocation in text form even if the national law of the consumer provides for a stricter form. If the consumer's national law provides for a simpler form than the text form (such as oral declaration), the declaration of withdrawal is also effective in the simpler form. The exercise of the right of withdrawal is also possible for all consumers by returning the goods in due time.

(6) For consumers with permanent residence in Switzerland, paragraphs 1 to 3 and the requirements and legal consequences of the German consumer right of withdrawal shall also apply if a revocation is not provided for under Swiss law.
