General Terms and Conditions (GTC) for "GLOW UP STUDIO" & "GLOWUPvienna"

Preamble
These General Terms and Conditions govern the contractual relationship between customers and "GLOW UP STUDIO", a brand of pilo OG, for the purchase and sale of retro lamps via online platforms such as Etsy and Willhaben.

§1 Scope
These GTC apply to all business relationships between "GLOW UP STUDIO" and its customers in the version valid at the time of contract conclusion.

§2 Contract Object
"GLOW UP STUDIO" offers table lamps, hanging lamps, and floor lamps in retro style for sale. The products comply with the applicable safety standards.

§3 Conclusion of Contract
The purchase contract is concluded as soon as the customer places an order and it is confirmed by "GLOW UP STUDIO".

§4 Warranty
The statutory warranty rights apply. The warranty period for consumers is two years from the delivery of the goods.

§5 Retention of Title
The delivered goods remain the property of "GLOW UP STUDIO" until full payment is made.

§6 Payment Terms
Payment options include Etsy Payments, cash payment, SumUp, or bank transfer.

§7 Delivery and Shipping
Delivery is made by GLS or the Austrian Post within the EU. Self-collection is also possible.

§8 Right of Withdrawal
Customers have the right to withdraw from the purchase contract within 14 days of receiving the goods. The cost of returning the goods is borne by the customer.

§9 Disclaimer
(1) "GLOW UP STUDIO" is not liable for damages resulting from improper use of the products. This includes damages caused by using the lamps contrary to the instructions, unauthorized modifications, and use in unsuitable environments.
(2) Liability for damages due to cable fire, electrical defects, or other product-related defects is excluded unless they are due to intent or gross negligence.
(3) "GLOW UP STUDIO" assumes no liability for indirect damages, consequential damages, or lost profits.
(4) Customers are obliged to use the products properly and take all necessary safety precautions.
(5) "GLOW UP STUDIO" is not liable for damages caused by force majeure.

§10 Privacy Policy
(1) "GLOW UP STUDIO" commits to protecting the privacy of its customers and treating their personal data confidentially. The privacy practices are outlined in the privacy policy on Etsy.

(2) To fulfill your order, it is necessary that you provide certain information, such as your name, email address, postal address, payment information, and the details of the product ordered. This information is transmitted from Etsy to "GLOW UP STUDIO".

(3) The use of your information occurs in several legally permissible ways, including:

To provide our services, such as to fulfill your order, to settle disputes, or to provide customer support;
When you have given your express consent, which can be revoked at any time, for example, by signing up for our newsletter;
If necessary to comply with a court order or legal obligation, such as retaining information about your purchases if required by tax laws;
As far as necessary for our own legitimate interests, provided these interests are not overridden by your rights or interests.
(4) Your personal information is shared only for very limited reasons and under limited circumstances, such as with Etsy, to provide you our services and fulfill our obligations under the Etsy seller guidelines and Etsy terms of use.

(5) "GLOW UP STUDIO" retains your personal information only as long as necessary to offer you our services and as described in our privacy policy. However, we may also be required to retain this information to comply with our legal and regulatory obligations, to resolve disputes, and to enforce our agreements. Typically, we retain your data for the following period: five (5) years.

§11 Your Rights
(1) If you reside in certain areas, including the EU, you have a number of rights regarding your personal information. While some of these rights apply generally, certain rights apply only in certain limited cases. Your rights include:

The right to access. You have the right to access the personal information we hold about you by contacting us.
The right to modification, restriction, or deletion. You also have the right to modify your personal information, restrict our use of this information, or delete your personal information.
The right to object. You can object to the processing of some of your information based on our legitimate interests and to receiving marketing messages from us.
The right to lodge a complaint. If you reside in the EU and have concerns about our use of your information, you have the right to address this with your local data protection authority.
